If you are a foreign investor or are considering purchasing an Airbnb property in Florida, it is crucial to understand the difference between Directly Related Income (DRI) and Fixed, Determinable, Annual, or Periodic Income (FDAP).
Fixed, Determinable, Annual, or Periodic Income (FDAP)
As a general rule, rental income earned by a foreign investor can be treated as Fixed, Determinable, Annual, or Periodic Income when it is considered passive income. In that case, they are normally subject to a 30% withholding tax on gross income, unless an applicable tax treaty or a specific provision of the Internal Revenue Code establishes a different treatment.
Effectively Connected Income (ECI)
U.S. tax law allows, under certain circumstances, a foreign investor to elect to treat certain income from real estate located in the U.S. as directly related income.
