Employers are required by law to withhold federal income taxes. The amount of withholding depends on several factors, such as the employee's marital status, number of dependents, and the salary amount. The idea is to approximate what the worker owes as income tax at the end of the tax year. The employer may determine the amount to withhold based on the information provided by the employee at the time of hiring (form W-4 Employee's Withholding Certificate) that must be completed prior to the beginning of employment. When the worker files their tax return, the amount withheld by their employer is deducted from the amount owed, resulting in a lower tax payment.

Taxes under the Federal Social Security Contributions Act (FICA) consist of elder, survivors, and disability insurance taxes, known as Social Security contributions, as well as hospital insurance contributions, known as Medicare contributions. These taxes have different rates.

The current tax rate for Social Security is 6.2% for the employer and 6.2% for the employee, totaling 12.4%. The current Medicare rate is 1.45% for the employer and 1.45% for the employee, totaling 2.9%. To calculate Social Security withholding, multiply your employee's gross wages for the current pay period by the current Social Security tax rate (6.2%). To calculate Medicare withholding, multiply your employee's gross wages by the current Medicare tax rate (1.45%). These taxes are reported on the same form (941) and are reported every three months.

Only Social Security taxes have a wage base limit. The wage base limit is the maximum wage that is subject to tax for that year. For income in 2023, this base is $160,200. There is no limit on the wage base for Medicare tax; all covered wages are subject to Medicare tax.

In addition to Medicare tax, employers are responsible for 0.9% additional Medicare tax on employee wages and compensation that exceed $200,000 in a calendar year, regardless of marital status. There is no employer match for the additional Medicare tax.

Employers file and pay federal unemployment tax (FUTA) separately from federal income tax and Social Security and Medicare taxes. Employees do not pay this tax, nor is it withheld from their pay. The FUTA tax rate is 6.0% (0.060) for 2023. Most employers receive a maximum credit of up to 5.4% (0.054) against the FUTA tax. Each quarter, you must calculate what portion of the first $7,000 of each employee's annual wages was paid by you during that quarter. It is filed on Form 940.

Lastly, there is the state unemployment tax (SUTA), which is a type of payroll tax that states require employers to pay. However, employees in Alaska, New Jersey, and Pennsylvania must also contribute to the tax. State unemployment offices or agencies assign employers a specific tax rate, and this rate can change based on annual assessments. Florida's 2023 SUI tax rates are dated December 22, 2022. The minimum rate is 0.10%, and the maximum rate is 5.4%, except that employers participating in the short-term compensation program may be subject to a maximum rate of 6.4%. New employers pay 2.7% in 2023. The final adjustment factor remained 0.000, and the multiplier decreased to 0.1628 for 2023. The taxable wage base remains $7,000.

If you have employees in only one state, you will only need to comply with that state’s SUTA tax regulations. But if you employ workers in more than one state, that is, if you are a multi-state employer, you must file SUTA taxes for each state in which your employees are located. Each state has its own SUTA regulations, so you should check with your state’s labor or unemployment department or agency for more information that may be relevant to your business.

The relationship between taxpayers and the IRS must ensure a fair balance, promoting cooperation, mutual respect, good faith, and collaboration between them. People have the civic duty to pay taxes and are responsible for fulfilling their tax obligations; the IRS, correlatively, is obliged to provide a timely service based on simplification, legality, equity, and respect for taxpayers and their rights.

This is why there is a Taxpayer Bill of Rights (TBOR), which is a document that lists 10 rights of the taxpayer in an informative manner, so that the taxpayer can know them and exercise them effectively. Below, each of them will be briefly explained:

<h2>1. The Right to Be Informed</h2>
Taxpayers have the right to know what steps they must take to comply with tax laws. In all tax forms, instructions, publications, notices, and correspondence, they have the right to receive accurate explanations of IRS laws and procedures. It is their right to receive clear explanations of the results of decisions the IRS makes about their tax accounts and to be informed about them.

<h2>2. The Right to Receive Quality Service</h2>
When dealing with the IRS, taxpayers have the right to receive clear, accurate, and expert assistance. They also have a way to communicate with a supervisor to report deficiencies in service.

<h2>3. The Right to Pay No More than the Correct Amount of Tax</h2>
Taxpayers have the right to pay only the legal amount of tax, including interest and penalties, and to have the IRS correctly credit those payments.

<h2>4. The Right to Challenge the IRS's Position and to Be Heard</h2>
In response to proposed or concluded actions taken by the IRS, taxpayers have the right to file objections and provide additional documentation. They must expect the IRS to consider their objections and submitted documentation in a timely manner, and if the IRS does not agree with the taxpayer's situation, the taxpayer has the right to receive a response from the IRS.

<h2>5. The Right to Appeal an IRS Decision in an Autonomous Forum</h2>
Taxpayers have the right to receive a written response explaining the decision of the IRS Appeals Office, as well as to file and receive a fair and impartial administrative appeal hearing of most actions taken by the IRS, including the assessment of many penalties. Taxpayers generally have the discretion to present their case in the appropriate judicial forum.

<h2>6. The Right to a Resolution</h2>
In addition to the maximum period in which the IRS may review or collect taxes for a particular tax year, taxpayers also have the right to know the maximum period in which they may challenge the IRS's position. They also have the right to know when the IRS has completed its review (audit).

<h2>7. The Right to Privacy</h2>
The IRS will respect all due process rights, including protection from searches and seizures, and will provide a due process hearing on collection where appropriate; furthermore, taxpayers have the right to expect that any inquiry, review, or enforcement action by the IRS will comply with the law.

<h2>8. The Right to Confidentiality</h2>
Unless the taxpayer authorizes it, he or she has the right to have any information he or she provides to the IRS not published. If this is not done, he or she has the right to have corrective action taken against persons who disclose such information.

<h2>9. The Right to Hire a Representative</h2>
Taxpayers have the right to hire an authorized representative to represent them in their matters with the IRS. If the taxpayer does not have enough money to hire a representative, he or she can receive help from the Low Income Tax Center.

<h2>10. The Right to a Tax System that is Fair and Adequate</h2>
If taxpayers experience financial difficulties or the IRS cannot resolve their tax problems quickly and correctly through normal channels, they have the right to assistance from the Taxpayer Advocate Service.

A taxpayer's filing status determines its options during year-end tax filing. Take the time to notify the Social Security Administration of any name changes completing Form SS-5 and to request a new Social Security Card. Additionally, you must report any address changes to your employers on Form W-4 and to the IRS using Form 8822. 

Taxpayers must submit a new Form W-4 to their employers within 10 days of their marriage or following the birth of a child. If both spouses work, they may move to a higher tax bracket or be subject to additional FICA taxes. 

Form W-4 is divided into 5 steps, but there are only two steps required for all employees: Step 1, where personal information (name and marital status) is entered, and Step 5, where the form is signed. Step 2-4 lists different options that you can choose from to make the necessary retention adjustments. Keep in mind that you must provide a Form W-4 for all your jobs. Doing so will make your withholding more accurately match your tax liability. If you don't make these adjustments, you'll likely owe additional tax when you file your tax return or might incur in interest and penalties. 

Taxpayers are required to make quarterly estimated tax payments to avoid any tax liability when filing their tax return when reporting income from other sources like the ones reported on 1099 forms. Income reported on 1099 forms include non-wage income from unemployment, self-employment, annuity income, gig economy, or digital assets.

Keep in mind that tax rates increase as income increases, and it's only possible to claim one standard deduction on each tax return, regardless of the number of jobs at home. If you have more than one job at a time or are married filing jointly and both you and your spouse work, a higher amount must be withheld from the combined household income. 

Remember that you can check your account with the IRS online if you need information, to get copies of previous tax returns or have received notices or letters from the IRS. 

Be aware that the IRS will never contact you via email, phone calls, social media, or text messages. If you are contacted by any of these means, it is most likely a tax scam.

 <li>In the future, does this activity will make a profit, and how much profit does it make?</li>
 <li>Will you be able to make a profit from the appreciation of the assets in use for this activity?</li>
 <li>Are you dependent on the income from your work for a living?</li>
</ol>

When being paid through payment apps for goods and services provided during the calendar year you will receive a Form 1099-K, whether the activity is a hobby or a business. These payments are taxable income and must be declared on your federal tax return. 

Money received from friends and family as a gift or repayment for a personal expense should not be reported on a Form 1099-K. These payments aren't taxable income. Be sure to note these types of payments as non-business in the payment apps when possible.

Avoid headaches, remember that good recordkeeping is one of the key factors for your business to succeed.

Through December 31, 2022, the energy efficient home improvement credit is a $500 lifetime credit. As amended by the Inflation Reduction Act (IRA), the energy efficient home improvement credit is increased for years after 2022, with an annual credit of generally up to $1,200. Beginning January 1, 2023, the amount of the credit is equal to 30% of the sum of amounts paid by the taxpayer for certain qualified expenditures, including: 
<ul>
<li>Qualified energy efficiency improvements installed during the year</li>
<li>Residential energy property expenditures during the year, and 
<li>Home energy audits during the year. </li>
</ul>

The following energy efficient home improvements are eligible for the Energy Efficient Home Improvement Credit:

<h2>1.	Building envelope components satisfying the energy efficiency requirements:</h2>
<ul>
<li>Exterior doors (30% of costs up to $250 per door, up to a total of $500);</li>
<li>Exterior windows and skylights (30% of costs up to $600); and </li>
<li>Insulation materials or systems and air sealing materials or systems (30% of costs). </li>
</ul>
<h2>2.	Home energy audits (30% of costs up to $150)</h2>

<h2>3.	Residential energy property (30% of costs, including labor, up to $600 for each item) satisfying the energy efficiency requirements:</h2>
<ul>
<li>Central air conditioners; </li>
<li>Natural gas, propane, or oil water heaters;</li>
<li>Natural gas, propane, or oil furnaces and hot water boilers; and</li>
<li>Improvements to or replacements of panelboards, sub-panelboards, branch circuits, or feeders that are installed along with building envelope components or other energy property </li>
</ul>

<h2>4.	Heat pumps and biomass stoves and biomass boilers (30% of costs, including labor) satisfying the energy efficiency requirements:</h2>
<ul>
<li>Electric or natural gas heat pump water heaters;</li>
<li>Electric or natural gas heat pumps; and</li>
<li>Biomass stoves and biomass boilers.</li>
</ul>
There are limits on the allowable annual credit and on the amount of credit for certain types of qualified expenditures. The credit is allowed for qualifying property placed in service on or after January 1, 2023, and before January 1, 2033.


The residential clean energy property credit is a 30-percent credit for certain qualified expenditures made by a taxpayer for residential energy efficient property. The IRA extended the residential clean energy property credit through 2034, modified the applicable credit percentage rates, and added battery storage technology as an eligible expenditure. The credit applies for property placed in service after December 31, 2021, and before January 1, 2033. The credit percentage rate phases down to 26% for property placed in service in 2033, 22% for property placed in service in 2034, and no credit is available for property placed in service after December 31, 2034.

The following residential clean energy expenditures are eligible for a Residential Clean Energy Property Credit of 30% of the cost:

<li>Solar electric property expenditures (solar panels);</li>
<li>Solar water heating property expenditures (solar water heaters);</li>
<li>Fuel cell property expenditures; </li>
<li>Small wind energy property expenditures (wind turbines);</li>
<li>Geothermal heat pump property expenditures; and</li>
<li>Battery storage technology expenditures.</li>

The credits are available only for certain improvements made to second homes, and the credits are never available when the improvements are made to homes not used as a residence by the taxpayer. For example, landlords can never use these credits for improvements made to any homes they rent out but do not use as a residence themselves. However, if a taxpayer is renting a home as their principal residence and makes eligible improvements, a tax credit may be available to such tenant.

Under the Energy Efficient Home Improvement Credit: a taxpayer can claim the credit only for qualifying expenditures incurred for an existing home or for an addition to or renovation of an existing home, and not for a newly constructed home.

Under the Residential Clean Energy Property Credit: a taxpayer can claim the credit for qualifying expenditures incurred for either an existing home or a newly constructed home.

For both credits, if a taxpayer uses property solely for business purposes, the property will not qualify for the credit. A taxpayer who qualifies for the credits and whose use of the qualified property for business purposes is not more than 20 percent may claim the full credit. For a taxpayer who otherwise qualifies for the credits, but whose use of the qualified property for business purposes exceeds 20 percent, the taxpayer must calculate the amount of credit by including only that portion of the expenditures for the property that are properly allocable to use for nonbusiness purposes.

When calculating the Energy Efficient Home Improvement Credit, a taxpayer may include the labor costs for the onsite preparation, assembly, or original installation of residential energy property such as central air conditioners; natural gas, propane, or oil water heaters; natural gas, propane, or oil furnaces or hot water boilers; electric or natural gas heat pumps; electric or natural gas heat pump water heaters; biomass stoves or biomass boilers; or improvements to panelboards, sub-panelboards, branch circuits, or feeders. In contrast, a taxpayer may not include the labor costs for qualified energy efficient building envelope components including a qualifying insulation material or system, exterior window, skylight, or exterior door. Thus, for an energy efficient building envelope component for which a taxpayer pays a fixed price, the taxpayer must make a reasonable allocation between the qualifying cost of the property and the nonqualifying labor cost of the installation. 

When calculating the Residential Clean Energy Property Credit, a taxpayer may include the labor costs properly allocable to the onsite preparation, assembly, or original installation of the qualified property and for piping or wiring to interconnect the qualifying property to the home.

In the case of building envelope components for which an Energy Efficient Home Improvement Credit is available (exterior doors, windows, skylights, insulation and air sealing materials or systems), the component must reasonably be expected to remain in use for at least 5 years.

There is no lifetime limit for either credit; the limits for the credits are determined on a yearly basis. For example, beginning in 2023, a taxpayer can claim the maximum Energy Efficient Home Improvement Credit allowed every year that eligible improvements are made.

Under the Energy Efficient Home Improvement Credit: a taxpayer may not carry the credit forward. Thus, if a taxpayer does not have sufficient tax liability to claim all or a portion of the credit in the year in which the related property for which the qualifying expenditure is placed in service, the unused amount of the credit may never be claimed.
 
Under the Residential Clean Energy Property Credit: a taxpayer may carry forward the unused amount of the credit to reduce tax liability in future tax years.
Used property is not eligible for the Energy Efficient Home Improvement Credit or the Residential Clean Energy Property Credit.

Both the Energy Efficient Home Improvement Credit and the Residential Clean Energy Property Credit are nonrefundable personal tax credits. A taxpayer claiming a nonrefundable credit can only use it to decrease or eliminate tax liability. A taxpayer will not receive a tax refund for any amount that exceeds the taxpayer's tax liability for the year.

A taxpayer who is subject to the AMT (alternative minimum tax) is eligible to claim both the Energy Efficient Home Improvement Credit and the Residential Clean Energy Property Credit and may offset the AMT with those credits.

A home energy audit to qualify for the Energy Efficient Home Improvement Credit must include an inspection of a dwelling, including condominiums and certain manufactured homes, located in the United States that is owned or used by the taxpayer as the taxpayer's principal residence. The home energy auditor must provide a written report (to the taxpayer) that identifies the most significant and cost-effective energy efficiency improvements for that dwelling, including an estimate of the energy and cost savings for each such improvement. The auditor must meet the certification or other requirements specified by the Department of the Treasury and the Internal Revenue Service in forthcoming guidance.

<ul>

Existen límites en el crédito anual admisible y en el importe del crédito para determinados tipos de gastos calificados. El crédito se permite para los bienes calificados puestos en servicio a partir del 1 de enero de 2023 y antes del 1 de enero de 2033.

El crédito a la propiedad residencial de energía limpia es un crédito del 30% para ciertos gastos calificados realizados por un contribuyente para la propiedad residencial de energía eficiente. La IRA amplió el crédito a la propiedad residencial de energía limpia hasta 2034, modificó los porcentajes de crédito aplicables y añadió la tecnología de almacenamiento en batería como gasto elegible.  <li>Gastos en tecnología de almacenamiento en baterías</li>
</ul>

Los créditos sólo están disponibles para determinadas mejoras realizadas en segundas residencias, y los créditos nunca están disponibles cuando las mejoras se realizan en viviendas que no son utilizadas como residencia por el contribuyente. Por ejemplo, los propietarios nunca pueden utilizar estos créditos para las mejoras realizadas en las viviendas que alquilan pero que no utilizan como residencia. Sin embargo, si un contribuyente alquila una vivienda como residencia principal y realiza las mejoras subvencionables, puede disponer de un crédito fiscal para dicho inquilino.

En el marco del crédito por mejora de la eficiencia energética de la vivienda: el contribuyente sólo puede solicitar el crédito por los gastos subvencionables en que incurra para una vivienda existente o para una ampliación o renovación de una vivienda existente, y no para una vivienda de nueva construcción.

En el marco del crédito para bienes residenciales de energía limpia: el contribuyente puede solicitar el crédito para gastos admisibles efectuados en una vivienda existente o en una vivienda de nueva construcción.

Para ambos créditos, si un contribuyente utiliza la propiedad únicamente con fines empresariales, la propiedad no podrá optar al crédito. Un contribuyente que reúna los requisitos para obtener los créditos y cuyo uso de la propiedad calificada para fines empresariales no supere el 20 % puede solicitar el crédito completo. En el caso de un contribuyente que, por lo demás, tenga derecho a los créditos, pero cuyo uso de la propiedad calificada para fines empresariales supere el 20%, el contribuyente deberá calcular el importe del crédito incluyendo únicamente la parte de los gastos de la propiedad que se puedan asignar correctamente al uso para fines no empresariales.

Al calcular el crédito por mejoras energéticas en el hogar, el contribuyente puede incluir los costos de mano de obra de la preparación, el montaje o la instalación original de bienes residenciales que consuman energía, como aires acondicionados centrales, calentadores de agua de gas natural, propano o diésel, calderas de agua caliente u hornos de gas natural, propano o diésel, bombas de calor eléctricas o de gas natural, calentadores de agua eléctricos o de gas natural con bomba de calor, estufas de biomasa o calderas de biomasa, o mejoras en tableros de distribución, subpaneles, circuitos derivados o alimentadores. Por el contrario, el contribuyente no puede incluir los costos de mano de obra de los componentes del cerramiento del edificio que cumplan los requisitos de eficiencia energética, incluidos los materiales o sistemas de aislamiento, las ventanas exteriores, las claraboyas o las puertas exteriores. Así pues, en el caso de un componente de la envolvente de un edificio energéticamente eficiente por el que el contribuyente paga un precio fijo, éste debe realizar una asignación razonable entre el costo calificado del bien y el costo de mano de obra no calificado de la instalación.

En el caso de los componentes de la envolvente del edificio para los que está disponible un crédito para la mejora de la eficiencia energética de la vivienda (puertas exteriores, ventanas, claraboyas, materiales o sistemas de aislamiento y sellado del aire), debe preverse razonablemente que el componente permanecerá en uso durante al menos 5 años.

No hay límite de por vida para ninguno de los dos créditos; los límites de los créditos se determinan anualmente. Por ejemplo, a partir de 2023, un contribuyente puede solicitar el crédito máximo para la mejora de la eficiencia energética de la vivienda permitido cada año en que se realicen las mejoras subvencionables.

En virtud del crédito para la mejora de la eficiencia energética de la vivienda: un contribuyente no puede trasladar el crédito al ejercicio siguiente. Tanto el crédito para la mejora de la eficiencia energética del hogar como el crédito para la propiedad residencial de energía limpia son créditos fiscales personales no reembolsables. Un contribuyente que solicita un crédito no reembolsable sólo puede utilizarlo para reducir o eliminar la deuda tributaria. Un contribuyente no recibirá un reembolso de impuestos por cualquier cantidad que exceda la obligación tributaria del contribuyente para el año.

Un contribuyente sujeto al AMT (impuesto mínimo alternativo) puede solicitar tanto el crédito para la mejora de la eficiencia energética del hogar como el crédito para propiedades residenciales de energía limpia y puede compensar el AMT con esos créditos.

Para poder acogerse al crédito para la mejora de la eficiencia energética del hogar, una auditoría energética debe incluir una inspección de una vivienda, incluidos los condominios y determinadas casas prefabricadas, situadas en Estados Unidos que sea propiedad del contribuyente o que éste utilice como residencia principal. Through December 31, 2022, the energy efficient home improvement credit is a $500 lifetime credit. As amended by the Inflation Reduction Act (IRA), the energy efficient home improvement credit is increased for years after 2022, with an annual credit of generally up to $1,200.

If you install qualified vehicle refueling and recharging property in your home or business, you may be eligible for the Alternative Fuel Vehicle Refueling Property Tax Credit. The credit was extended and modified by the Inflation Reduction Act (IRA). The credit allowed is based on the placed-in-service date for the qualifying property.
The credit is available to businesses and individuals that place qualified refueling property into service during the tax year.
To qualify for the credit, refueling property must be used to store or dispense clean-burning fuel or to recharge electric motor vehicles.
In addition, the property must:
<ul>
 <li>Be placed in service during the tax year</li>
 <li>Have original use that began with the taxpayer</li>
 <li>Be used primarily in the U.S. and U.S. territories&nbsp;</li>
 <li>If not business or investment use property, be installed on property used as a main home</li>
</ul>
As of January 1, 2023, qualifying property is limited to property placed in service in eligible census tracts. An eligible census tract is a population census tract that is a low-income community or that is not an urban area.
Also as of this date, the Inflation Reduction Act expands qualified property to include:
<ul>
 <li>Charging stations for 2- and 3-wheeled electric vehicles (for use on public roads).</li>
 <li>Bidirectional charging equipment (vehicle connected to the grid or V2G)</li>
</ul>
Likewise, as of that same date, the credit for qualified refueling property subject to depreciation equals 6% with a maximum credit of $100,000 for each single item of property.
Businesses meeting prevailing wage and apprenticeship requirements may be eligible for a 30% credit with the same $100,000 limit.
For qualifying property not subject to depreciation, the credit equals 30% of the cost with a maximum amount of $1,000 per item.
For property placed in service before January 1, 2023 (including personal property), the credit is 30% of the cost of qualified refueling property with a maximum total credit allowed of $30,000 per location for depreciable property and $1,000 per location for all other property.
Partnerships and S corporations must file Form 8911 to claim the credit. All other taxpayers are not required to complete or file the form if their only source for this credit is a partnership or S corporation. Instead, they can report this credit directly on line 1s of Part III of Form 3800, General Business Credit.
The portion of the credit for business or investment use of refueling property is treated as a general business credit carried from the Form 8911 to the Form 3800 and subject to the rules applicable to the general business credit.
The portion of the credit for personal use of refueling property cannot exceed the excess of the regular tax liability reduced by certain allowable credits over the tentative minimum tax (if any) for the taxable year as determined on Form 6251. The personal use part of the credit is carried from Form 8911 to the Form 1040, Schedule 3.
The basis of any refueling property for which a credit is taken must be reduced by the amount of the credit.
The credit is subject to recapture if the property the credit applied for ceases to qualify within 3 full years from the placed-in-service date.

Generally, when talking about federal electric vehicle tax credits in the United States, most people refer to the New Electric Vehicle Credit. But that&rsquo;s not the only federal tax credit for buying an electric vehicle. Starting in 2023, there are two new electric vehicle tax credits: The Used Clean Vehicle Credit and the Clean Vehicle Trade Credit.
A new clean vehicle is a clean vehicle placed in service on or after January 1, 2023, acquired by a taxpayer for its original use. In addition, to qualify for the credit, the vehicle cannot be acquired for resale, must be manufactured by a qualified manufacturer, and must have final assembly in North America.
As of the above date, qualifying vehicles will be eligible for a tax credit of up to $7,500. It is important to note that this credit is non-refundable, that means you cannot receive more money from the credit than you owe in taxes. You also cannot reinvest the remainder in any taxes owed in the future.
Multiple taxpayers may acquire, place in service and own the same vehicle. However, only one taxpayer may claim the clean new vehicle credit per vehicle placed in service, and the credit may not be allocated or prorated among multiple taxpayers.
You may not claim the credit if your modified adjusted gross income (AGI) exceeds certain thresholds. This limitation is based on the lesser of your modified AGI for the year that the new clean vehicle was placed in service or for the preceding year. The relevant modified AGI thresholds are as follows:
<ul>
 <li>Married filing jointly or filing as a qualifying surviving spouse or a qualifying widow(er) &ndash; $300,000</li>
 <li>Head of household &ndash; $225,000</li>
 <li>All other taxpayers &ndash; $150,000</li>
</ul>
The vehicle will not be eligible for the credit if the manufacturer&rsquo;s suggested retail price (MSRP) of the vehicle exceeds the following values:
<ul>
 <li>Vans, Sport utility vehicles, Pickup trucks: $80,000</li>
 <li>Other &ndash; $55,000</li>
</ul>
The Previously Owned Clean Vehicle Credit is a credit of up to $4,000 for the purchase of an eligible previously owned clean vehicle with a sale price of $25,000 or less that is placed in service during a tax year by a qualified buyer. To claim the credit, a qualified buyer must meet certain income requirements and it must be the vehicle&rsquo;s first qualified sale since Aug. 16, 2022, other than to the original owner.
A previously owned clean vehicle is a motor vehicle that meets the following requirements:
<ol>
 <li>The model year of the vehicle is at least two years earlier than the calendar year in which a taxpayer acquires the vehicle.</li>
 <li>The purchasing taxpayer is not the original user of the vehicle.</li>
 <li>The vehicle was acquired for a sales price of $25,000 or less from a dealer and the purchasing taxpayer is the first qualified to claim the credit since Aug. 16, 2022, other than its original user.</li>
</ol>
To qualify for the deduction, you must:
<ul>
 <li>Be an individual who bought the vehicle for use and not for resale</li>
 <li>Not be the original owner</li>
 <li>Not be claimed as a dependent on another person&rsquo;s tax return</li>
 <li>Not have claimed another used clean vehicle credit in the 3 years before the purchase date</li>
</ul>
In addition, your modified adjusted gross income (AGI) may not exceed:
<ul>
 <li>$150,000 for married filing jointly or a surviving spouse</li>
 <li>$112,500 for heads of households</li>
 <li>$75,000 for all other filers</li>
</ul>
To qualify for the credit, the previously owned clean vehicle must be purchased from a dealer.
Like the new clean vehicle credit, the used clean vehicle credit cannot be carried forward and is not refundable.
A taxpayer can claim a Qualified Commercial Clean Vehicle Credit for purchasing and placing in service in the taxpayer&rsquo;s business a &ldquo;qualified commercial clean vehicle&rdquo; during the taxable year. The taxpayer must use the vehicle for a &ldquo;business use.&rdquo;
A &ldquo;qualified commercial clean vehicle&rdquo; is defined as any vehicle of a character subject to the allowance for depreciation that is made by a qualified manufacturer, acquired for use or lease by the taxpayer and not for resale and treated as a motor vehicle is manufactured primarily for use on public streets, roads and highways&nbsp;
This tax credit, which can be claimed by businesses and tax-exempt organizations, is worth up to:
<ul>
 <li>$7,500 for qualified vehicles with gross vehicle weight ratings of less than 14,000 lbs.</li>
 <li>$40,000 for all other vehicles.</li>
</ul>
It is equal to the lesser of:
<ul>
 <li>30% of your basis in the vehicle (total cost after taxes and registration).</li>
 <li>The incremental cost of the vehicle (excess of the purchase price versus a comparable internal combustion engine vehicle)</li>
